7. Platform Access and Compliance Policy

BetsWave is committed to the promotion of responsible platform usage practices and to ensuring that its platform is accessed only by eligible users in permitted jurisdictions. This section sets out the platform's access policy, eligibility requirements, jurisdictional restrictions, and responsible usage commitments. These provisions are operative as both platform policy and contractual obligations under the Platform Terms of Service.

7.1. Age Verification and Eligibility

The BetsWave platform is intended exclusively for eligible adults. Access to and use of the platform, including the submission of service requests and the acquisition of WAVE Tokens or ORCA NFTs in connection with platform participation, is strictly restricted to:

  • Persons who are at least eighteen (18) years of age; or
  • Where applicable local law prescribes a higher minimum age for participation in digital asset or platform activities, persons who meet that higher minimum age requirement.

BetsWave reserves the right to implement eligibility verification measures and to restrict or terminate access for any user who cannot satisfy applicable requirements. Users are required to warrant that they meet the applicable eligibility requirement as a condition of platform access, and this warranty is incorporated into the Platform Terms of Service.

7.2. Jurisdictional Restrictions and Excluded Territories

Due to varying regulatory frameworks governing digital asset services, blockchain-based platforms, and data processing services across global jurisdictions, the BetsWave platform may not be available to users in all territories. BetsWave maintains a list of excluded territories — jurisdictions from which the platform does not accept participation — which is set out in the Platform Terms of Service and updated periodically as regulatory conditions change.

Without limiting the scope of the excluded territories list, users are advised that access to blockchain-based platforms and digital asset services may be regulated or restricted in numerous jurisdictions globally, including certain states within the United States of America, and various countries with restrictions on digital asset activities. It is the sole responsibility of each user to determine whether their access to and use of the platform is lawful in their jurisdiction of residence and location of access.

BetsWave reserves the right to implement geofencing, IP-based access restrictions, and other technical controls to prevent access from excluded territories. The implementation of such controls does not relieve users of their independent obligation to comply with applicable local law.

Jurisdictional Disclaimer: BetsWave is operated from Costa Rica. The platform makes no representation that access is lawful in any jurisdiction outside of Costa Rica. Users who access the platform from other jurisdictions do so voluntarily and at their own risk and are solely responsible for compliance with all applicable local laws. The Platform Terms of Service contain the definitive list of excluded territories.

7.3. Responsible Usage Commitment

BetsWave is committed to implementing responsible platform usage measures designed to support user wellbeing and to ensuring that access to platform services is conducted in accordance with applicable policies and user preferences.

The platform's responsible usage framework includes or is intended to include the following features, subject to technical implementation timelines:

  • Self-Limitation: A mechanism enabling users to voluntarily restrict their platform access for a defined or indefinite period.
  • Usage Limits: Tools enabling users to set daily, weekly, or monthly deposit and usage limits.
  • Activity Monitoring: Internal monitoring processes designed to identify patterns of platform usage that may require user support or compliance intervention.
  • Support Signposting: Provision of information directing users to appropriate regulatory bodies or consumer protection resources in their jurisdiction.

BetsWave encourages any user who wishes to limit their platform usage or who has concerns regarding their engagement with the platform to make use of available self-limitation tools and to contact the platform support team.

7.4. Platform Access Controls

BetsWave reserves the right, at its sole discretion and without prior notice, to restrict, suspend, or terminate access to the platform for any user where:

  • The user is located in or accessing the platform from an excluded territory
  • The user fails to satisfy applicable eligibility verification requirements
  • The user has failed to complete applicable KYC or AML verification procedures
  • The user's activity is suspected to involve money laundering, fraud, or other unlawful conduct
  • Regulatory requirements or applicable law require such restriction
  • The user has violated the Platform Terms of Service

Platform access controls are designed to support regulatory compliance and responsible platform usage obligations. Implementation of access controls does not constitute an admission of any legal obligation and does not give rise to any claim by a restricted user for compensation or damages.
